Terms of service
Terms for using ChickenSign
1. What ChickenSign does
ChickenSign is an e-signature service for documents you supply. It does not produce documents, and it does not use the documents you upload except to send them for signature on your instructions. You upload your own PDF, place signature, initial, date, and tick fields, and send each signer a private signing link. ChickenSign also emails that link. Signers do not need an account. When signing is complete, ChickenSign returns your signed PDF and a signing record: an audit trail, the consent wording accepted, timestamps, and SHA-256 fingerprints of the file before and after signing.
2. Legal scope: simple electronic signatures only
- A signature made with ChickenSign is a simple electronic signature. Section 7 of the Electronic Communications Act 2000 makes it admissible in evidence.
- It is not an advanced or qualified electronic signature (AES or QES). ChickenSign is not a qualified trust service provider. You must not describe a ChickenSign signature as AES or QES, or use it where a counterparty, registry, or regulator requires one.
- Excluded documents. You must not use ChickenSign for wills and codicils; lasting powers of attorney; statutory declarations, affidavits, or other sworn or affirmed documents; deeds, including transfers of land and any document needing a witness who is physically present; or any other document for which the law requires a wet-ink signature, witnessing, notarisation, or a specific registry process.
ChickenSign does not witness signatures, does not execute deeds (including under section 44 of the Companies Act 2006), and does not offer video witnessing.
ChickenSign is not a law firm and does not give legal advice. Our legal notes (chickensign.com/legal) describe the product. You are responsible for whether a document, and electronic signature, is right for your purpose.
3. Your account
You must give accurate details and keep your login and API keys secure. We recommend turning on two-factor authentication. You are responsible for activity under your account and keys. If you think your account or a key has been compromised, tell us through @justarieldotcom and revoke the key in Desk > API.
4. Plans and pricing
| Plan | Price | Includes |
|---|---|---|
| Free | £0 | 10 envelopes per calendar month. Upload any PDF, private signing links, audit trail and SHA-256 certificate, two-factor authentication. |
| Unlimited | £9.95 per month, as shown on the site | Unlimited envelopes, CSV batch sending, REST API keys and webhooks, sequential and parallel multi-party signing, and automated card billing with monthly receipts. |
- On the free plan, each envelope you create in a calendar month counts as one towards the allowance of 10. Unused allowance does not roll over to the next month.
- “Unlimited” is subject to the fair use rules in section 6.
- Unlimited is billed monthly in advance by card through our payment processor and renews automatically until cancelled.
- We may change prices with at least 30 days’ notice by email. The new price applies from your next billing date after the notice ends. You can cancel before then.
5. Cancellation and refunds
- You can cancel any time with one click in your desk billing settings. Unlimited stays active until the end of the paid month, then your account moves to the Free plan. Your documents and records are not deleted when you downgrade.
- Where the law requires a refund, including the consumer right below, that right applies. Otherwise, fees already paid are not refunded when you cancel part-way through a paid month.
- Consumers: if you buy as a consumer, you have a 14-day right to cancel under the Consumer Contracts Regulations 2013. If you ask us to start the service straight away and use it within those 14 days, we may deduct a proportionate amount for the service already provided.
6. Fair use and API limits
- Each API key is limited to 60 requests per minute (rolling window). Requests above the limit receive HTTP 429 with a Retry-After header. You can have up to 5 active keys.
- Do not try to get around rate limits, for example by rotating keys. Do not send at a volume or in a pattern that degrades the service for others.
- If your use is far above what is normal for a small business, we will contact you before taking any action.
7. Acceptable use
You must not use ChickenSign to:
- send spam, phishing, or documents that impersonate another person or organisation
- get signatures through deception or pressure, or forge signatures
- upload unlawful, infringing, or malicious content (including malware)
- process special-category personal data without a lawful basis
- break the law, including consumer, data protection, and anti-money-laundering law
- probe, scan, or test the vulnerability of the service, or reverse engineer it, except as the law allows
We may suspend sending, or remove content, if we reasonably believe these rules are being broken.
8. Your content and data
- You keep all rights in the documents you upload. You give us a limited licence to host, process, and transmit them only to provide the service.
- You decide how your documents and your signers’ personal data are used. FCOMS UK CIC is the data processor: it stores and processes them only to deliver the signing service on your instructions, and not for any other purpose. Our privacy notice explains how. You must have a lawful basis to share signers’ details with us, and you must tell signers how their data is used.
- Documents and audit records are kept for six years by default, or twelve years if you choose. You can export your desk or delete a document at any time. Deleting a completed document means its certificate code stops verifying, so keep your own copy of signed documents.
- If you send documents to consumers, you are responsible for giving them any pre-contract information and cancellation-right notices the law requires (for example under the Consumer Contracts Regulations 2013).
9. Availability and changes
We aim to keep ChickenSign available but do not guarantee it will be uninterrupted or error-free. We may change or improve features. If we remove a material paid feature, we’ll give notice and you can cancel.
10. Suspension and termination
You can close your account at any time. We may suspend or close an account for a serious or repeated breach of these terms, non-payment, or where the law requires it. Where it’s reasonable, we’ll give notice and a chance to fix the problem first. If we end the service for everyone, we’ll give at least 30 days’ notice so you can export your records.
11. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow to be limited. Consumers keep their statutory rights.
- We are not liable for whether a document is legally valid or enforceable for your purpose, or for use of ChickenSign for an excluded document.
- For business users, we are not liable for loss of profit, revenue, business, or goodwill, or for indirect or consequential loss.
- Except for the liabilities that cannot be limited, as set out above, FCOMS UK CIC’s total liability for a claim is capped at the subscription fee you paid for the one month in which the claim arose. If you paid no subscription fee in that month, including because you were on the Free plan, the cap is £0.
12. Changes to these terms
We may update these terms. We’ll email account holders about material changes at least 30 days before they take effect. If you keep using ChickenSign after that, the new terms apply.
13. Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that consumers living in Scotland or Northern Ireland may also bring proceedings in their local courts.
(This is separate from the governing-law choice you make inside the documents you send.)
